Wages and Payment Structure

At Heartfelt Care Services Limited, we pay our staff based on their level of experience, ensuring fair compensation for their skills and qualifications. The hourly rates we charge to the client are all-inclusive and cover the candidate's wage, holiday pay, National Insurance contributions, administrative costs, and our agency fee.

The wages we pay to our candidates are structured as follows:

  1. Candidates with Up to 1 Year of Experience:

    • We pay our staff £12.21 per hour for candidates in this category.

  2. Candidates with 2-4 Years of Experience:

    • We pay our staff £12.00 per hour for candidates with intermediate experience.

  3. Candidates with Over 4 Years of Experience:

    • We pay our staff £12.50 per hour for those with extensive experience in their field.

These wage levels reflect the skills and qualifications of each candidate. The final hourly rate charged to the client includes additional costs such as holiday pay, National Insurance, administrative expenses, and the agency’s management fee.

  2. Candidates with 2-4 Years of Experience: £19.01/hour

Components of the Client’s Hourly Rate:

  1. Candidate's Wage: This is the base wage paid to the candidate.

  2. Holiday Pay: 12.07% of the candidate’s wage.

  3. Employer's National Insurance Contribution (NIC): 13.8% on earnings above the Secondary Threshold (£175 per week or approx. £4.17/hour).

  4. Administrative Costs: Estimated at £2.00 per hour.

  5. Agency Profit Margin: We’ll assume a 15% margin for the agency.

Final Hourly Price Calculations for the Client

1. Candidates with Up to 1 Year of Experience

  • 1. Base Wage: £11.50/hour

    2. Holiday Pay (12.07%):

    • £11.50 × 12.07% = £1.39/hour

    3. Employer’s NIC:

    • £11.50 - £4.17 (threshold) = £7.33

    • £7.33 × 13.8% = £1.01/hour

    4. Administrative Costs:

    • Estimated at £2.00/hour

    5. Total Cost Before Profit:

    • £11.50 + £1.39 + £1.01 + £2.00 = £15.90/hour

    6. Agency Profit (15%):

    • £15.90 × 15% = £2.39/hour

    7. Final Hourly Price for Client:

    • £15.90 + £2.39 = £18.29/hour

2. Candidates with 2-4 Years of Experience

  • 1. Base Wage: £12.00/hour

    2. Holiday Pay (12.07%):

    • £12.00 × 12.07% = £1.45/hour

    3. Employer’s NIC:

    • £12.00 - £4.17 (threshold) = £7.83

    • £7.83 × 13.8% = £1.08/hour

    4. Administrative Costs:

    • Estimated at £2.00/hour

    5. Total Cost Before Profit:

    • £12.00 + £1.45 + £1.08 + £2.00 = £16.53/hour

    6. Agency Profit (15%):

    • £16.53 × 15% = £2.48/hour

    7. Final Hourly Price for Client:

3. Candidates with Over 4 Years of Experience

  • 1. Base Wage: £12.50/hour

    2. Holiday Pay (12.07%):

    • £12.50 × 12.07% = £1.51/hour

    3. Employer’s NIC:

    • £12.50 - £4.17 (threshold) = £8.33

    • £8.33 × 13.8% = £1.15/hour

    4. Administrative Costs:

    • Estimated at £2.00/hour

    5. Total Cost Before Profit:

    • £12.50 + £1.51 + £1.15 + £2.00 = £17.16/hour

    6. Agency Profit (15%):

    • £17.16 × 15% = £2.57/hour

    7. Final Hourly Price for Client:

Short-Term Staff Placement Agreement Between Heartfelt Care Services Limited (Agency) and Client

  1. Definitions:

    • The Agency refers to Heartfelt Care Services Limited.

    • Client means the individual or business requesting staffing services from the Agency.

    • Candidate refers to the staff member provided by the Agency to the Client for temporary work assignments.

  2. Scope of Agreement:

    • The Agency agrees to supply the Client with qualified staff for short-term positions per the Client's specified needs.

    • The Client acknowledges and agrees to the terms and conditions set forth herein and accepts the Candidate provided by the Agency under these terms.

  3. Candidate Qualifications and Client Responsibilities:

    • The Agency will ensure that the Candidate possesses the qualifications and experience for the role, as requested by the Client.

    • The Client will oversee the Candidate's day-to-day duties and ensure a safe and compliant working environment, following all relevant health and safety legislation.

  4. Rates and Fees:

    • The Client agrees to pay the following hourly rates based on the Candidate's experience:

      • Up to 1 year of experience: £11.50 per hour

      • 2-4 years of experience: £12.00 per hour

      • Over four years of experience: £12.50 per hour

    • All rates exclude VAT if applicable and are payable by the Client within 14 days of the invoice date unless otherwise agreed in writing.

  5. Invoicing and Payment Terms:

  7. The Client will be invoiced weekly, fortnightly, or monthly.

    • Invoices: Invoices will be issued weekly at the end of each week in which personnel have been provided. The Client agrees to pay the Agency within seven days from the invoice date.

    • Late Payments: In the event of delayed payment, a late fee of 3% per week will be applied. If payments are delayed by more than 14 days, the Agency reserves the right to suspend personnel provision until outstanding amounts are settled.

    • Payments are due within 14 days from the invoice date. Late payments may incur interest or legal action.

  8. Assignment Duration:

    • Both parties will mutually agree upon the placement's duration before the assignment's commencement.

    • The Agency and the Client must confirm any assignment extension in writing.

  9. Cancellation Policy:

    • If the Client cancels a confirmed placement within 24 hours of the scheduled start time, a cancellation fee of 50% of the first day's charges will be applied.

    • No charges will apply for cancellations made at least 24 hours before the scheduled start time.

  10. No refund is applicable for short-term placements once the candidate has started the assignment.


    Responsibilities of the Parties

    Agency Responsibilities:

    • Source and screen candidates based on the Client's requirements.

    • Verify candidate qualifications, experience, and references.

    • Ensure candidates are informed about the job description and requirements.

  11. Limitation of Liability:

    • The Agency will not be held responsible for any loss, expense, damage, or delay resulting from its inability to provide a Candidate for all or part of the agreed assignment.

    • The Client is responsible for overseeing and managing the Candidate's work and ensuring it meets the required standards.

  12. Candidate Replacement:

    • If the Client deems the Candidate unsuitable within the first 4 hours of the assignment, the Client may request a replacement Candidate. In such cases, the Client will not be charged for the hours worked by the unsuitable Candidate.

    • After the initial 4 hours, total fees apply. The Agency will then make every reasonable effort to provide a replacement Candidate within a reasonable timeframe.

  13. Confidentiality:

  • Both the Client and the Agency agree to maintain the confidentiality of any personal or business information shared during the agreement, both during and after the assignment.

  1. Termination of Agreement:

  • The Client or the Agency may terminate the agreement with seven days' written notice.

  • If the Client terminates the agreement prematurely, the Client will pay all hours worked up to the termination date.

  1. Governing Law:

  • This agreement will be governed and interpreted by the laws of England and Wales. Any disputes arising from this agreement will be resolved in the courts of England and Wales.

  1. Additional Provisions:

  • Any amendments or variations to these terms must be agreed upon in writing by both the Client and the Agency.

  • The Client agrees not to hire the Candidate directly or indirectly within 12 months of the assignment's conclusion unless the Agency agrees in writing.

Permanent Placement Process

Client Offers Permanent Employment:

Once clients determine a suitable candidate, they may extend a permanent job offer. In this scenario, the client offers the candidate a role hourly rate of £12.50/hour (equivalent to £26,000 per year based on a 40-hour workweek).

Agency Notification:

After deciding to hire the candidate permanently, the client notifies the agency. The agency will then issue an invoice for the placement fee, which is 25% of the candidate's first-year salary (e.g., £6,500 for a wage of £26,000).

Candidate Acceptance:

The client formally offers the candidate salary details and employment terms. Upon the candidate's acceptance, the employment agreement is confirmed.

Employment Commencement:

Once the candidate begins their role, they officially become the client's employee. At this point, the agency's involvement in the placement concludes.

Refund Policy (Permanent Placement)

If the candidate leaves the client's employment within 90 days of their start date, the following refund policy applies:

  • Full Refund:

  • If the candidate departs within the first 30 days of employment, the agency will refund 100% of the placement fee.

  • Partial Refund (50%):

  • If the candidate leaves between 31 and 60 days, the agency will refund 50% of the original placement fee.

  • Partial Refund (25%):

  • If the candidate leaves between 61 and 90 days, the agency will refund 25% of the original placement fee.

Refunds will only be issued if the candidate remains employed within 90 days.

Cancellation Terms

If the client or the candidate withdraws from the placement before the candidate's official start date, there will be no cancellation fees. Both parties may cancel without any financial obligation.

  • Estimated Annual Salary: Ranges from £31,200 to £39,000 depending on the number of hours worked per week (48 to 60 hours).

  • Placement Fee: Ranges from £7,800 to £9,750 (25% of the estimated annual salary).

Permanent Placement Process

  1. Client Offers Permanent Employment:
    Once the client determines that the candidate is suitable, they may extend a permanent job offer. In this scenario, the client offers the candidate a role at an hourly rate of £13.50/hour (equivalent to £28,080 per year 40 hours /week).

  2. Agency Notification:
    After deciding to hire the candidate on a permanent basis, the client notifies the agency. The agency will then issue an invoice for the placement fee, which is 25% of the candidate's first-year salary (e.g., £7,020 for a salary of £28,080).

  3. Candidate Acceptance:
    The client makes a formal offer to the candidate, including salary details and employment terms. Upon the candidate's acceptance, the employment agreement is confirmed.

  4. Employment Commencement:
    Once the candidate begins their role, they officially become the client’s employee. At this point, the agency’s involvement in the placement concludes.
